Contracting Parties
The charter contract is concluded between the client who charter the vessel (“Client”) and the owner of the yacht, represented by Encore Yacht Charters (“Company”)
Booking Confirmation
From the Client’s side, the booking intention is confirmed when deposit payment is paid by the Client.
From the Company's side the booking will be confirmed when the deposit amount lands in their bank account and Booking confirmation is issued to the Client or the Agency.
Payment Methods
After the yacht charter reservation has been agreed, which will be effective in writing only, the payment is to be done according to the following:
Based on a day charter rate, £1000 non refundable deposit will be due at time of yacht reservation
Full balance will be due no later than 14 days prior to charter
If either deposit payment or full balance payment has not been fully settled in line with the above stated deadlines, the Company shall be entitled to cancel the Vessel’s booking without any refunds to the Client.
In some circumstances such as a half day or moored charter the deposit will vary and will be agreed by the Company and the Client at time of booking.
All names of charter guests are to be provided to the Company within 7 days of the charter.
Cancellation by Client
Cancellation within 14 days of charter - 100% cancellation fee
Cancellation outside of 14 days of charter - Loss of deposit
For exceptional circumstances such as an act of god, sudden health conditions, death in near family the Company will enable the deposit to be used on a future booking within 2 years
Cancellations by Company
Should the booking be cancelled by Company, then the Company will offer to Client:
Full refund of all monies paid towards charter
Alternative yacht if possible with refund of any price difference if lower and no increase in price if higher charter value.
Security deposit
A security deposit of £2000 will be required separate from booking deposit. This deposit may be given either in cash or with one of the credit cards accepted by the Company. After the completion of yacht charter the whole Deposit shall be repaid to the Client, unless some Vessel damages or loss of equipment have occurred
In the event of damages the price of the damage will be deducted from the deposit, in the event of larger damage the full security deposit will be held by the Company and the Client will have no rights to a refund.
Complaints
If the Client has a complaint they must send this in writing to the relevant member of the Company they made the booking with. The Company will reply within 2 working days.
The Company obligations
The Company will provide the yacht fully insured and to the standards set on them by the Maritime and Coastguard Agency (MCA) Codes of Practice.
The yacht will be to the standard advertised to the Client and any changes or deviations to this will be reported to the Client immediately.
